SkyHistory End User License Agreement (“EULA”)

This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Scand Ltd. – the author of this software called SkyHistory (refers to all variations of the product), which includes computer software and may include associated media, printed materials, and “online” or electronic documentation (“SOFTWARE PRODUCT”).

By installing or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.

SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

1. GRANT OF LICENSE

This EULA grants you the following rights:

Installation and Use

You are granted a non-exclusive, non-transferable right to install the SOFTWARE PRODUCT on a single computer and to make a single archival copy of the SOFTWARE PRODUCT.

This SOFTWARE PRODUCT consists of two parts:

  • BASIC, that contains standard functionality;
  • ENHANCED, that contains some advanced functionality.

You are granted a non-exclusive, non-transferable right to use the BASIC part of the SOFTWARE PRODUCT on a single computer for free.

In order to unlock and receive the right to use the ENHANCED part of the SOFTWARE PRODUCT, you must purchase a license key on Scand Ltd. Web site. The license key gives you right to use minor releases of the ENHANCED part of the SOFTWARE PRODUCT published within one year from the date of purchase, and also obtain bug fixes on confirmed problems within one year from the date of purchase.

You are not allowed to use the ENHANCED part of the SOFTWARE PRODUCT without a license key, registered for your name.

Reproduction and Distribution

You may not reproduce and distribute the SOFTWARE PRODUCT.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

Limitations on Reverse Engineering, Decompilation, and Disassembly

You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

Separation of Components

The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one
computer.

Termination

Without prejudice to any other rights, the author of this Software may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

Distribution

The SOFTWARE PRODUCT may not be sold, rented, offered for download on an internet site or be included in a product or package which intends to receive benefits through the inclusion of the SOFTWARE PRODUCT. The SOFTWARE PRODUCT may not be distributed in any way. You may however obtain a download link from Scand Ltd. and place this on your website. Please contact us via our website for more details.

3. COPYRIGHT

All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and “applets” incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by the Author of this Software. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material except that you may install the SOFTWARE PRODUCT on a single computer provided you keep the original solely for backup or archival purposes.

4. LIMITED WARRANTY

No warranties

The author of this Software expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided “as is” without warranty of any kind, either expressed or implied, including, but not limited to the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.

No liability for damages

In no event shall the author of this Software be liable for any (direct or indirect) damages whatsoever (including, without limitation, damages relating to the loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the Author of this Software has been advised of the possibility of such damages.

5. UPGRADES, UPDATES AND ENHANCEMENTS

All upgrades, updates or enhancements of the SOFTWARE PRODUCT shall be deemed part of the SOFTWARE PRODUCT and will be subject to this Agreement.

6. LEGENDS AND NOTICES

You agree that you will not remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the SOFTWARE PRODUCT or any accompanying documentation.

7. COPYRIGHTED MATERIAL

The SOFTWARE PRODUCT is not intended and should not be used for illegal or infringing purposes, such as the illegal copying or sharing of copyrighted materials. Using the SOFTWARE PRODUCT for such purposes is, among other things, against international copyright laws and contrary to the terms and conditions of the End User License Agreement. Such activity may be punishable by law.

Check your local laws before using the SOFTWARE PRODUCT.

The Author disclaims all responsibility for any consequence incurred as a result of using this SOFTWARE PRODUCT.

8. INFORMATION SAFETY

Scand Ltd. collects only the information that you provide to us in order to obtain commercial or evaluation license, to be able to identify you as a registered user, and to record your consent. During the purchase process or obtaining a trial license, you give an explicit consent for Scand Ltd to use this information in accordance with the terms and conditions of Scand’s Privacy Policy located at https://scand.com/privacypolicy. We do not gather any personal information without obtaining your consent first. If you want to view, edit or destroy this information, please submit your request to GDPR@scand.com and we will proceed in accordance with the European Union’s General Data Protection Regulation and privacy laws of other countries applicable that provide certain rights for data subjects.
